These terms and conditions set out the rules for using the WiFi network at the Automobile Club de l’Ouest (ACO) head office and, more widely, within the grounds of the Circuits du Mans racetrack (hereinafter “the Site”).
It explains what users are required to do by law and to ensure that this Internet service operates as efficiently as possible.
The ACO provides free access to the 24H LE MANS WiFi network to anybody with a smartphone, WiFi-enabled laptop or tablet.
Users must read and agree to the terms and conditions of use before logging onto the network.
Users have to create an account in order to use the WiFi network, and may be required to register online. Users may be given free or paid access to the network, depending on arrangements made with the Automobile Club de l’Ouest.
Coverage is generally provided in areas where the 24H LE MANS network is visible. The Site WiFi network can be used to browse the Internet and to send and receive email.
WiFi users must adhere to the following principles. Use of the service implies that the user expressly agrees to comply with these Terms and Conditions, without having to sign anything.
Users undertake to not use the WiFi service for any illicit, prohibited or unlawful purposes and must comply with regulations with regard to the following (this is a non-exhaustive list):

By accepting the Terms and Conditions of use for this service, users acknowledge that they have received all the necessary information concerning the specifications and terms of use of the service, and understand that failure to comply with the terms may result in access to certain sites, servers or data being revoked.
Users are responsible for the security and protection of their devices. The ACO will not be held responsible for any connection problems encountered by computers, smartphones or tablets. ACO staff will not deal with users’ personal equipment.
The ACO reserves the right to temporarily or definitively suspend use of a service without being held liable and without the user being entitled to any sort of compensation or redress.
The ACO cannot be held liable for any direct or indirect damages incurred as a result of using the service. Users acknowledge that the ACO cannot be held responsible for the content accessed by users and that the accessibility of content and services is not guaranteed and may be suspended without notice.
All services used generate "traffic data", which is a history of the actions carried out by users.
However, the use of the WiFi network is not anonymous.
In application of the French counter-terrorism law of 23 January 2006, supplemented by the decree of 24 March 2006 relating to the storage of electronic communication data, traffic data is kept for one year from the day it is recorded
In the event of legal proceedings, these files must be made available to the courts "for the purposes of investigating, establishing and prosecuting criminal offences". An extract from these files will then be linked to the extract from the database of the users concerned.
Other information may be stored if so required by changes to the legislation, in which case users will be informed immediately. Any user who contravenes the rules set out above may have their Internet access account via the WiFi network withdrawn, and disciplinary and criminal proceedings may be undertaken, as provided for by the legislative and regulatory texts in force.
